Well after nearly 2 years since this all started. All started with selling a fiesta back in July 07, then the new owner getting a refund on the tax in November 07, they say I still owned the vehicle, well at the expensive of the DVLA they finally took me to court and they have dismissed it unless the DVLA want to pursue it more which I doubt as its been already chucked out once. Finally after 2 years since selling the car I dont need to worry about this :D

I presume the new owner was still driving the car, even though they refunded the tax, and that was the issue?

Yep new owner, drove the car till november where he took it off the road and refunded the tax to himself. The DVLA said I still owned the vehicle and therefore owe them tax as the vehicle is not SORN/destroyed.
