I thought i would share this experiance.

As i was having a clearout i sold a boxed populous pc game(the photo of which had the contents all displayed), as some of you know im somewhat anal and everything was checked before it left, the box was in great condition and the cd was as though it had never been played (100% scratch free)


I had a message via ebay from the buyer

Buyer

Hello. The item you sent me is slightly damaged, the disc has a number of scratches too. I am not happy that this wasn't mentioned as it affects the items value and playability.
Please let me know if theres anything you're willing to do.

Unfortunatly my sent messages dont seem to have saved but i offered a full refund on return of the item..

The buyer then said hes not willing to do that as he would have to catch a bus that will cost him to take it to the post office and instead that he would like £4 (the game cost £7)

I suggested if hes not happy to pay for the bus , that he should get jogging (i used these exact words)



And then... It began,

More comments: First communication was fine, we were getting somewhere. Then I was told to "Jog on" which in england, constitutes to two rude words I won't say but look like "F*** O**" Obviously for a seller to say this is inappropriate in itself. But then the seller has been uncooperative with my needs. I am not able to "Jog on" and the nearest post office is out of my reach without assistance. It is not the sellers responsibility to provide any special services for me, but to make fun of me when I can't "Jog on"? Thats highly inappropriate. Not to mention the item was missing the limited edition statue. The box was damaged and the disc is unreadable. Considering the item was listed "Very good" this is not the correct description? It was "Acceptable" at best. In anycase, the best solution would be a partial refund of £4 to get the disc fixed so at least that works. The seller claims they tested it, yet there are numerous scratches on the back which I can provide proof of via pictures. They may have tested it on one machine, however I tested it on 3 machines before saying anything, all with different operating systems to make sure that was not the problem. And clearly, it isn't. The disc is damaged, which means this item is not as described. I do not wish to do this, but I will never accept sub-par to the description items.
The buyer did not give permission to share a phone number with you.

"Im confused, originally it was due to the cost of the bus, now its due to you not being able to, I have to travel to post items aswell, unforutnatly i do not have a post office built into my house either. The game was not listed as limited edition, the entire contents of the box was spread (no statue in sight), so why on earth would there be a statue in there ? Im perfectly happy to resolve problems when there is a genuine problem , however your story has to many holes and i know the cd was in perfect condition when it left myself. Ive offered a full refund in return of the game which the 'Sales of goods act' quite rightfully upholds in order to protect buyer, however i will require the product back in its as sold condition. If you are not happy with this i suggest you escalate this claim to paypal.

"In that case then arrange for a courier, they will collect the item from yourselves and provide a tracking number, all you will need to do is answer the front door to them. Please re read the original ebay advert 'You are bidding on an original big box populous the begining , complete with everything you see in the photo (manual etc)' Please dont try to tell me you didnt look at the photo when purchasing. The simple fact is you want somthing for nothing, and wish to leave an honest ebay seller out of pocket, whilst you have another game to add to your collection. Enjoy"

The game is about 1kg and measures around 30cm by 45cm!. You live in gl7 5se, < that is a normal area, no additionals costs like highlands etc> I sent a box at 250cm , 100cm, and weighing 20kg, for £6.19. Please your story is full of holes. ( i just did a quote on your address and its £3.99) Ive typed it multiple times, no statue. Please feel free to attempt to rip of another genuine seller. "

"Well yeah thats exactly what it is, that adds up. Why do you insist on twisting the story? It is acceptable at best, but I never described the CD as that. I have said from the beginning it wasn't readable from multiple computers. Do you live here? Do you pass through here? I have to pay for extra for parcels out here, theres hardly any access to anything here. I can't help that, but don't tell me what isn't true. It costs a hell of a lot to get couriers out here and makes day to day living quite difficult. I was not rude in any previous messages, you commented that the the bus costs money, just like petrol costs money which my car requires to drive to the post office to post this game, however this is somthing that as to make life easier for ourselves we pay for, if you do now wish to pay then i suggested you jog to the post office?. I do now know about any potential difficulties you may have nor is it any of my buisness, why not ask somebody to even take the game to the post office for you? "

The result was that paypal refunded him, not me.. im very surprised that paypal are willing to take a hit just to keep a buyer happy , even though they admit he must have been at fault. I hope i dont come across rude to people, the fact was i knew that game was perfect , £9 really wouldnt bother me, if it was a genuine guy id of said , here is a full refund, keep the game and sorry, but this guy was a con man.

edit.. ive no idea about this statue thing, it was just a normal pc game.. i even searched the google archive and could not find anything to do with a statue :S.. strange guy

It boils my piss when people on eBay take the absolute Mickey. He sounds like he was a few sandwiches short of a picnic.

Why should he have been issued a partial refund if u have no proof of the cd not working? Just his word isn't good enough to issue a refund.

I put a item (metal bulkhead) for my transit connect which had a 99p start- 18 people watched it and it didn't sell- why wouldnt u bit bid for 99p lol

i had the same thing happen to me, sold a piece of diagnostic equipment for £510, put pictures up showing that it had a few lines on the screen.- customer wasnt happy. - said it was unviewable. - wanted £200 back.- i said no and to go through ebay.
he claimed he would be happy to have a full refund. - in actual fact he was behind the scenes emailing me saying he then wanted £150....
i said that id happily refund the money provided i had the unit in my hand - he didnt like that.
i even turned round and said i'd be able to get a replacement screen, to which he replied that he'd found a screen and had it fitted for £100. - which is total rubbish as there were only two sellers of the product in the UK, spares are very hard to come by and new screens are being sold for £500!
in the end i waited 45days, the customer claimed to have sent it me back in the post - but didnt give ebay a tracking number, so i got my £510 back and it affected my seller rating. - Good old Mr Hussain from Bradford...... :cartman:

although it has to be said, ebay were a VERY difficult company to deal with. - emails that made no sense, basically copied and pasted from some help guide. - the chat help facility was manned by morons and the phone helpdesk appeared to be manned by american's with no clue of the outside world. - maybe it helped i kept complaining the ebay throughout......

I think the fact is.. a lot of ebay sellers worry so much about there rating that if somebody asks for a partial refund they just pay it no questions asked..

However im pretty sure that ebay legally cannot take a partial amount of money out of your account and refund the seller, after all , what answer would you get it you bought a £200 jacket from all saints, but took it back due to a loose stitch and demanded a £100 refund .. :S.. Just not the way it works, ah well, Ive just banged up about another 25 pc games... round 2 maybe ??

When I advertised a CD I put up good close up photos of it so that it was clear there were no scratches.

Even then he was talking about limited edition statues, I personally feel people use ebay, and ebays ability to always side with the buyer as a tool much like walking into shops and pocketing goods, only they feel less morally bad for it.

showing additional photos costs additional money, and when items generally go round 5/6+ times before being purchased it soon adds onto the ever increasing bill of ebay selling.

I sell replica stickers on eBay and send each of them signed for delivery. Even to Argentina so I get a tracking number which keeps eBay happy. I had a message from eBay telling me that they had removed some ratings feedback due to somebody giving me a 1 star for postage. If they dont like the price dont pay it, simple as that. I even sell at a loss on postage to go abroad but I have no issues with people coming up with saying they didn't get the items, even though once in Argentina it took about a month to get to the person, lucky that they had purchased about 10 sets off me previously and knew I was trusted.

Only issue I had was selling some spark plugs. eBay and Paypal had their address as a closed down pub. They didn't turn up at their address but didn't send recorded. But like your case they refunded the buyer but I kept the money as well because they said it was eBays problem for not updating an address. 3 weeks later the plugs returned back to my address though :wasntme:

I had this with an intercooler, guy messaged me saying it was missing a few clips & the intercooler had a rub mark (which you could clearly see) in the end I just refunded him £20 & he was happy. I just didn't want Ebay or Paypal to side with them as they seem to & be out of pocket £150..
I rarely sell on ebay now as it sucks for the seller.

With power tools etc people are buying used and returning their own faulty drills or expensive ni cad/lithium ion batteries, for working ones from eBay sellers.. A few people are being turned over.

anything like that i always mark the item with a security marker then take a photo under blacklight so i know its my item if it ever comes back. as there are some cheeky c**nts out there

our ebay department at work, sometimes gets empty boxes being sent back. - the buyer has proof of sending, so who is to say the royal mail didnt pilfer it? :coffee:
although our ebay dept did get one over someone the once, by showing that there was a massive descrepancy in the weight of the posted item to the returned item!
